PROHIBITED BUSINESSES

List of Activities and Businesses Not Permitted

To maintain compliance with applicable laws, financial regulations, and internal risk management standards, KardPH prohibits certain types of businesses, activities, and practices from using its services.

This list is representative but not exhaustive. If you are unsure whether your business falls under a prohibited category, please contact us at support@kard.ph before attempting to use the Kard.ph platform.

By registering for and using our services, you confirm that you will not use KardPH to accept payments or conduct transactions in connection with any of the following:

Gambling and Games of Chance

  • Unlicensed or illegal gambling operations
  • Internet gambling (including sports betting, online casinos, poker, and lotteries)
  • Sweepstakes, raffles, and contests requiring payment for participation
  • Any gambling activity not explicitly authorized by the Philippine government or applicable regulatory body

Illegal Products, Services, and Activities

  • Cannabis, CBD, and other controlled substances (including related paraphernalia)
  • Peptides, research chemicals, and substances mimicking illegal drugs (e.g., salvia, kratom)
  • Toxic, flammable, explosive, or radioactive materials
  • Fake documentation services, including forged IDs and reference providers
  • Drug-related devices such as bongs, vaporizers, and hookahs
  • Pornographic or obscene materials and services, including:
    • Adult live chat, escort services, strip clubs, and sexually-oriented massage parlors
  • Telecommunications and surveillance circumvention tools (e.g., jammers, interception devices)
  • Pseudo-pharmaceuticals or unverified medical products
  • Activities in violation of national or local laws in jurisdictions where services or products are offered

Intellectual Property Infringement

  • Sale or distribution of counterfeit goods (e.g., designer knockoffs, pirated software/media)
  • Unauthorized sale, resale, or access to copyrighted or trademarked materials
  • Illegally imported/exported goods or parallel imports
  • Products or services that infringe upon another party’s trademark, copyright, patent, or trade secret rights

Unfair, Predatory, or Deceptive Business Models

  • Pyramid or Ponzi schemes; "get rich quick" opportunities
  • Negative response marketing and misleading subscription traps
  • “Pay-to-remove” content (e.g., mugshot websites)
  • Resale of government services without value-added processing or authorization
  • Services that add no discernible value to the buyer (e.g., reselling free content)
  • Sale of fake social media engagement (e.g., likes, views, followers)
  • Sale of in-game currency or account boosting services in violation of platform terms
  • Unregistered charities or fundraising organizations
  • Aggregators that collect or pool funds on behalf of others without proper licensing
  • Businesses that engage in, promote, or glorify violence, hatred, or discrimination against individuals or groups based on race, religion, gender, orientation, nationality, or other protected characteristics

High-Risk Financial Practices

  • Use of KardPH primarily as a virtual terminal to key in cardholder data manually
  • Card testing, transaction laundering, and processing without legitimate underlying goods/services
  • Cross-border acquiring or evasion of local card network rules
  • Use of KardPH to store or share cardholder information with third parties for cross-selling or linked transactions

Regulatory and Policy Compliance

We reserve the right to decline or terminate services to any business that:

  • Violates any applicable law or regulation
  • Poses an elevated risk of fraud, chargebacks, or financial harm
  • Fails to meet KardPH’s internal compliance standards
  • Engages in conduct deemed unfair, deceptive, harmful, or predatory

Important Note:

KardPH reviews accounts regularly and may request additional documentation or suspend accounts for review. Violations of this policy may lead to immediate account suspension or termination.
